1. Explain the purpose and provisions of the Mental Health Act?

Mental Health Act 1983

The mental health act of 1983 came into existence as a commandment in England and Whales which says to keep people with mental disorders in hospitals and they should be dealt without their approval for the wellbeing of their own health and for the security of the community. These all decisions of admitting people into the hospitals are carried by some highly qualified doctors and experts or on the order of the courts. People suffering under the mental health act are monitored every hour by an appointed clinician who is responsible for the safety of the particular person. This act gives very limited power of appealing against the detention while a bit of freedom related to meeting their family members is allowed on request. People who recover are released later under the restrictions of a community treatment order (NHS, 2013).

Mental Health Act 2007

Mental Health Act 2007 was also introduced in England and Wales with considerable amendments in Mental health act of 1983and it also contains the amended Mental Capacity Act 2005. This act and the provisions it gave were effective since November 2008. The act introduced the treatments supervised by the community, noticeable changes in the professional role of the clinicians, and the act also introduced the dispossession of liberty safeguards which were not the part of mental capacity act 2005. Most of the safeguards incorporated in mental health act of 2007 are appreciated and owned by the clinicians and care providers. Some of the clauses amended have become controversial as it has increased the work load of the clinicians' (Ali, A., 2009).
