Introduction

Imagine you are a US Supreme Court justice. The following case comes before you and you have to decide.

An award-winning children's book contains the word “scrotum.” Some parents filed a lawsuit because they believe the book is obscene. In your judicial opinion (which is, of course, based on the US Constitution), is this book obscene?

Include in your answer the following information:

What is the specific constitutional issue?

How would you vote and why?

USC 1470 - Whoever, using the mail or any facility or means of interstate or foreign commerce, knowingly transfers obscene matter to another individual who has not attained the age of 16 years, knowing that such other individual has not attained the age of 16 years, or attempts to do so, shall be fined under this title, imprisoned not more than 10 years, or both.

The children are minor and thus the information used in the book is obscene matter which should not be passed to the children until they reaches the age of 16 or over.

I would vote that the book is obscene because such words increase the curiosity among the children to learn more and in this way they are exposed to obscene material prior to their age which is not legally correct.

What were the two major controversies that we discussed in class that were faced by framers of the Constitution at the Constitutional Convention? How were these solved? How did these compromises work out in the longer term? Discuss each one separately.

The two major issues which the framers faced were the Representation issue and the power of the federal government.

Representation issue involved to select the representatives. The lager states wanted representation to be based on population whilst smaller states wanted it equally.
