Introduction

This term paper endeavours to focus the breaks to international law, mainly in the prospect of a human rights violation has been committed against the Turkmeneli Turks in the aftermath of the Iraq conflict in 2003. These encompasses the continuing endeavours by the Iraqi cantered governments, the regional Kurdish government, the Arab and Kurdish nationalist rebels to inhabit their territory, to change the demography of their region and to decimate their national and ethnic identity; mainly by the use of force, widespread persecution, atrocities, and terror. I will contend the period genocide is applicable to recount the overhead deliberate acts, which encompass deliberate campaign of massacre, impoverishment, abduction, torture, and deportation, negligence of the political representation right and cultural destruction of the Turkic speakers.

To manage this I will give a short introduction to the Turkmeneli region, Turkic history in the region and their constructive roles. Then I will be focusing on the systemic “ethnic cleansing” (Hassani 1956 45) which has been committed against the Iraqi Turks since the invasion of Iraq in 2003 by the coalition forces, especially in periods of political negligence and misrepresentation of dimensions and span of population, whereby I will issue out the breaks of International Law (IL). Bearing in brain there is an argument amidst the scholars regarding the interpretation of the lawful doctrine. In that some contend that the IL is a well characterised doctrine body but is not complied, other ones glimpse it as mostly is obey. However other perceives see it as problematic body of doctrine.

Background

The Iraqi Turkic descendents are the third biggest ethnic assembly in Iraq after the Arabs and the Kurds. They reside in Turkmeneli region, which is a diagonal flat land located in the north of Iraq, enclosed by the hills and boundaries Syria in the north, Iran in east and Baghdad in the south. Kirkuk is the capital of Turkmeneli and one of its strategic cities. Thus, Turkmeneli compromise some other large towns, they starting from north are: Talafar, Arbil, AltunKopru, Kirkuk, Tuz, Kifri, Daghuk, Hanakin, Karatapa, Kizilrabat and Medeli, these towns are enclosed with hundreds of villages and divides between the Arab and Kurdish regions. (Abdul 1956 68)

The systemic conflict against the Iraqi Turks started a short while after the Ottoman Empire had lost World War1 in 1918 and collapsed; then Iraq became part of the British Empire. Some of the major causes were because the Iraqi Turks had opposed the British invasion and denied to vote into agency Feisal as a king who was a powerful British ally, therefore they were advised as powerful partners of the Ottoman Empire.

This situation dramatically intensified with the US invasion of Iraq in April 2003, when the Kurdish militia have boosted to inundate in 1000 to the towns of Turkmeneli (Edward 2005 5)
