Introduction

Saif al-Islam Gaddafi was born on June 5 in 1972. He is the son of Libyan leader Muammar al-Gaddafi, Chairman of the Gaddafi Development Foundation. Saif Al Islam Gaddafi was born in Bab-e-Azizia in Tripoli. He used to live with the family of Colonel Muammar Gaddafi. He is the second son of Colonel Gaddafi from his second wife Mrs. Safia Farkash. Including Saif al-Islam Gaddafi he has five brothers and one sister. He raised and invited a lot of controversy. Many people argue that he is the accuser of many crimes against peace and humanity. Whereas, there are also people who support him. The aim and objective of this paper is to talk about Saif Al Islam Gaddafi and his crimes from both the perspectives. This paper presents arguments in favor as well as against Saif Al Islam Gaddafi.

Arguments against of Saif Al Islam Gaddafi

The following part of the paper discusses arguments against Saif Al Islam Gaddafi. The arguments that are presented below suggest that Saif Al Islam Gaddafi is an accuser of the crimes against humanity and peace.

Accused of humanity

When the judges of the ICC found that Libyan leader Muammar Gaddafi, his son Saif Al Islam Gaddafi and an intelligence chief officer Abdullah Al Senussi are indulged in crimes that can be regarded as the crimes against humanity then by taking the notice of these crimes the judges of the ICC issued the arrest warrants against these three people. The judges of the ICC found the grounds that suggest that these three people are indulged in murder and persecution they released the warrant for the arrest of these three. The judges of the ICC released this warrant on June 27, 2011. In his application for the warrants, filed on May 16, the Prosecutor alleged that Gaddafi “conceived and implemented, through persons of his inner circle” such as Saif Al Islam and Al Senussi, “a plan to suppress any challenge to his absolute authority through killings and other acts of persecution executed by Libyan Security Forces. They implemented a State policy of widespread and systematic attacks against a civilian population, in particular demonstrators and alleged dissidents.” The ICC Prosecutor has subsequently suggested he may seek additional charges related to sexual assault (Lambert Surhone and Susan, 2010).

On 3 March 2011, the ICC Prosecutor had decided to open a formal investigation into the violence in Libya. In unanimously adopting Resolution 1970 (2011), the UNSC considered that the widespread and systematic attacks taking place in Libya against the civilian population may amount to crimes against humanity and decided to refer the situation in Libya to the ICC Prosecutor to investigate crimes committed from 15 February 2011 onwards (Oxford Business Group, 2011).
