Introduction

Simcoe County is known as the best groundwater in the world. The choice of five urban nodes makes better use of infrastructure, and has the potential to have a lower overall environmental impact than Simcoe County's 2008 Official Plan, which added sprawling, lowdensity development in every municipality in Simcoe County. Indeed, streamlining planning activities in the County might reduce the instances of ill-equipped municipal planning departments making recommendations to Councils that impede the area's long-term sustainability and prosperity. The County of Simcoe is the proponent of Site 41 and the Ministry of the Environment (MOE) is the regulator. Site 41 has received all the required ministry approvals, including a Certificate of Approval for a waste disposal site (CofA) (April 1998); a Certificate of Approval for storm water management (June 2004); and a Permit to Take Water (PTTW) (Crawford, 2009)

Role of MOE

The ministry is responsible for ensuring the County builds and operates Site 41 according to the conditions of its Certificates of Approval and Permit to Take Water and ensuring the site is built and operated in a manner that protects the environment and human health.It is MOE's role to make sure the site is properly managed and the County meets strict environmental standards. (Schauer, 2008)

The ministry has set out conditions to make certain the landfill is constructed using engineering techniques and natural features that will protect groundwater and surface water, with no adverse impact to water resources. The ministry will also closely monitor the operation of the site.

Simcoe County's proposed landfill Simcoe Area Land Budget" which notes that while realigning and phasing land supply, before new greenfields can be developed, municipalities must first promote infill and redevelopment and prioritize intensification and development to areas where access to employment, commercial services and public facilities already exist ( (Bast, 2008) The search for a new landfill for the four North Simcoe municipalities, Tiny, Tay, Penetanguishene, and Midland began in 1979. The North Simcoe Landfill Site (NSL) was selected in 1986 as the preferred site through a comprehensive process that evaluated the entire area. Each short-listed location was further compared on a set of 20 technical criteria such as hydrogeology, traffic and economics. The Joint Board, in two lengthy hearings, extensively reviewed the site selection process and the hydrogeological findings for the site and on February 2, 1995 granted approval for the North Simcoe Landfill Site. In 1998 the Ministry of the Environment issued a Certificate of Approval with conditions identified by the Joint Board. Further technical studies were conducted by the County and reviewed by the CMC and Tiny Township. On October 20, 2006 the Ministry of the Environment granted final approval for the site.
