Executive Summary

This paper discusses the notion of good governance in Brunei Darussalam, particularly in the context of public administration. The law that immune public administrators from the tortious and contractual liabilities is taken into consideration to discuss good governance in Brunei.

In Brunei, public administrators were caught in illegitimate practices and misuse of their power and authority because of this immunity law. This law on one hand protect public administrators from the risk and uncertainty associated with their nature of the job; however, the increased in number of cases of misuse of power due to the immunity clause, gain the attention of the general public and policy makers as this law results in general public losses and harms.

Therefore, it is proposed that policy makers and Government of Brunei must take initiatives by considering policy options, such as making the stringent monitoring system for public administrators through the introduction of ICT systems in scrutinize the activities of public administrators. This system must be transparent and encourage open and feedback of external actors to assess the effectiveness of proposed policy options on the continuous basis. Moreover, a new institution will also be introduced that facilitates the timely and real-time availability of information whenever this law was questioned because of misuse of power by public administrators.

It can be evidently concluded that good governance refers to the responsible and accountable power and authority use by public administrators. The proposed policy options will help the establishing control over activities of public administrators and to some extent they are afraid to hold liable because of transparent and open check and balance, which will eventually helps in establishing good governance in Brunei.

Introduction

In practice and theory, public administration and governance are ineradicably connected. For a long period of time, a good public administration system has been a driving force of sound governance. Both external (the global development assistance community) and internal (developing countries) asked for augmented “decentralization,” “rule of law,” “accountability,” “transparency,” and “participation” has been the motivator for reassigning the public administrators' role in good governance, particularly in Brunei (Hazair, 2007, p.1).

Good governance refers to a public service that is well-organized, a system of justice that is trustworthy and consistent, as well as an administration that is liable to the public. Good governance should imitate the public determination and will. The main constituent of good governance refers to the liability play a significant role in protection of citizens through taking into consideration complaints cropping up because of maladministration, like improper service, negligence, failure to pursue proper procedures and unnecessary delays) by public officials.
