Is bounty hunting legal?

Though bounty hunting is legal, but the laws imposed on bounty hunting vary from state to state. According to various states and their laws, the rights of bounty hunters vary. Bounty hunters have more rights to arrest than the local police. In the bail bond contract, after the signature by the defendant, they deprive themselves from the constitutional rights. Through the contract they agree that they can be arrested from the bounty hunters (Neubauer, 2010).

The bounty hunters are required to have a bail piece which mentions that the person is fugitive. Bounty hunters are not required to possess warrants. They are allowed to enter the private property without announcing and are not required to read their Miranda rights before making an arrest. They are allowed to enter any personal property only after having a clear doubt that the fugitive is hiding there. Depending on the state laws, bounty hunters may require a license which is required after registration. States such as Illinois, Oregon and Kentucky have prohibited the bounty hunters to make bail arrests. The bounty hunters are required to possess court orders. After the fugitive is found, the court orders the local police for the arrest. Upon the request of bounty hunter, the prisoner can be handed to the bounty hunters custody. The main and most important limitation on bounty hunters is that they cannot go aboard and operate their function there. They are limited and confined to the borders of United States. Outside US, they can be arrested and shot according to the laws of other countries (Hart, 1961).

Contract

This section will discuss if Eddie and Jack have negotiated a contract. Usually hiring a bounty hunter goes through a process of signing a legal contract. This contract also includes how much the bounty hunter will be paid for the work. Signing the contract with bounty hunter is very important. This can happen that the bounty hunter goes against his own guarantee and verbal agreement. It is viewed that bounty hunters are greedy with their money. Therefore, if no legal contract is signed they can easily go away with it.

Bounty hunters are independent contractors who work for bail bond service. Only those individuals are pursued by them who have availed the bail bonds service to post bail and do not show up in court. Bounty hunters can be approached through bonding company (Peri, 2012).

According to law, contract is an agreement related tot eh creation, assignment, delegation and transfer of rights and obligation, goods or services and entitlements.
