Introduction

Jane Joe is a mentally challenged 40 years old women, she works for T-Partay condominium complex and is single. The pay which she receives from there being a janitor is quite low. During this hard period of job dissatisfaction she meets Jack Brown. He from his outer personality looks like a nice individual. He presents himself as if he wants to help Jane in return for a small job, that giving him the key. The other person in the picture was Ms. Wealthy, who is living at this place with a lot of wealth. The Key belongs to the house of Ms. Wealthy.

The last person in the picture is Jim; he is a convicted Felon who keeps his identity low. Most of the character in this scenario, participated either unwillingly or willingly which led to the catching of Jack. Thus what can be the judgment of prosecutor so as to compensate the victim and the punishing of offenders? Most of them will be charged, so it is important to go step by step that is person by person basis.

18 USC Chapter 19 As 371: Conspiracy to commit offence

Conspiracy was hatched in which Jack Brown was helped by Jane Doe to commit crime. This crime was to be hatched against Mrs. Wealthy, in which Jane was to provide the keys of Mrs. Wealthy to Jack for $500. Thus the keys were provided by Jane and she received the bribe. Although, she was not directly involved in carrying out crime, but she knew that crime is going to take place in the T-Partay. The penalty related to this crime is prison up to five years or fine. In some cases both of them i.e. fine and prison can be awarded.

18 USC Chapters 51 AS 1111: Murder Second-Degree

Jim was murdered by Jane Doe, who was the accomplice of Jack Brown. Jane did not kill in defense, since when Jim came he did not have gun. So Jane did not have immediate danger from Jim, and will face charges for second degree murder. Second degree murder carries prison term up to life imprisonment or any year. Unless the mitigating and aggravating factors play a part, the factors which are aggravating in this case are the personal prior criminal records on which the sentencing is based.
