Rule
Under the Rules and Regulations specified by the concerned Department of U.S which grants Asylums, asylum may be granted to an individual if
He is a Refugee (Refugee is an individual, outside the country of his/her nationality. He/she is unwilling or unable to return his country of origin because he has a well-founded fear of persecution or has been persecuted before.
The CAT bars the person's return to a country which has ample chances of having danger of being subjected to torture, if he/she returns.
Judging by these two clauses, Mr. Does' claim or written testimony of account which is provided along with the details highlights four incidents of persecution that already took place. The reason of persecution he specifies to be his homosexual orientation. The accounts which Mr. Doe provides show that he was indeed a victim of prosecution and torture and furthermore, that the government was unable or un-inclined to persecute the individuals who were responsible for the acts.
From the initial time at college and university, Mr. Doe claims persecution because of his different sexual orientation. As he enters the university fields and the professional field, he claims more and more serious forms of persecution or aggression aimed at people with different sexual orientation. The fact that he was actively involved in some campaigns for the overall betterment of the people after publicly proclaiming his orientation might unfortunately be a negative for him.
