Introduction

In this assignment of law, legal opinion would be provided for four different cases in accordance with a hypothetical law. The study will assume that an act to regulate night clubs in the city of Melbourne and to control young people's behavior at these night clubs has been proposed and passed by the Australian parliament.

Summary

In accordance with the Victorian Parliament, the act may be cited as the Melbourne Night Clubs Act 2012 (Vic), (“the Act”). The main purpose of this act is to develop and maintain the peace at night clubs and avoiding any kind of conflict in night clubs, while at the same time containing the behavior of the young people. The act is to be considered effective by January 1st, 2012. Every night club of Melbourne city must comply and follow the rules and procedures defined in this act. Every night club are required to close at 2:00 am and it shall be an offence to remain open after that time and will be penalized $2,000.00. The serving of alcohol at any night club after 1:45 am shall constitute an offence under this Act and will be penalized an amount of $2,000.00 for committing this crime. The drinking of alcohol by any young person in night clubs after 2:00 am shall constitute an offence under this Act and will be penalized an amount of $1,000.00. Any person who, at any night club, is found in possession of a flick knife, a pen knife or any other item that can be used as a weapon shall commit an offence under this Act and will be penalized an amount of $5,000.00.

Case 1

Stella was about to leave the Trend Night Club in the City of Melbourne when she realized that she desperately needed to go to the toilet. As she had a weak bladder and wanted to avoid an embarrassing trip home, she asked Jordan, the manager of the Trend Night Club, for permission to use the toilet before she left the Club. Jordan checked his watch. It was 1:58 am. Jordan told Stella that she could use the toilet but she would need to hurry as it was almost closing time. At 2:03 am Stella was still in the toilet. Jordan was standing at the only remaining open door to the Club when he was approached by police officer, McLeod. Officer McLeod asked why the Club was still open. Although Jordan explained that he was waiting for a customer to leave the Club, officer McLeod charged the Trend Night Club for being in breach of Section 4 of the Act.

In accordance with the section 4 of the act, Jordan the manager of Trend Night Club has violated the law, but the purpose behind keeping the club opening is fair and justifiable.
