Introduction

Currently victimology has become relevant because each day more notorious violent acts against innocent people. We believe that the main victim of violence is the women, children in family and me at work. It took several years Scottish's political forces to achieve an agreement that would provide solutions to the tragedy of the victims of violence. To fight against violence, to signify forbidden, it must be laws both ambitious and fully implemented. In this paper, we are going to focus on Scottish law for victims of violence (Dutton, 2006, 7). A research has found that Scots are almost three times assaulted as Americans excluding murders.

What legislation is currently in force to assist victims of violence?

In this paper, of the paper we are mainly going to discuss protection law for victims of violence against domestic violence. Currently in Scotland Domestic violence Act (Scotland) is used to assist victims of violence. The act does not mean that the State assumes full responsibility for the disaster, but it should be taken as an expression of generosity towards those who were not responsible and had to suffer the consequences, either in its entirety, in their families or their heritage.

According to the law domestic violence is a pattern of constant use of physical force or psychological violence, intimidation or prosecution against a person on behalf of his spouse, former spouse, person who cohabits or has cohabited, person who holds or has had a consensual relationship or person with whom he fathered child to cause physical harm to his person, their property or to cause serious emotional damage (Phillipson, 2003, 726). The law says that, any person who is a victim of domestic violence can go to the police station nearest you and file a complaint of the commission of any of the following offenses:

Abuse

Aggravated abuse (violation of protective order, in the presence of (A) lower, etc.)

Abuse by threat

Abuse by restriction of freedom

Sexual assault (sexual intercourse without consent)

The Order of Protection

According to Domestic violence Act anyone who has been a victim of domestic violence may file itself, through its legal representative or a peace officer, a petition in the Court and request a protective order without requiring prior filing of an indictment. With the protective order may order the following remedies:

To order the abuser to refrain from threatening, intimidating or abusing.

To order the abuser to vacate the apartment they share.

To order the abuser not to enter the residence, workplace, school children (as), etc.

To be granted custody of their child (ren) and ordered to pay child support to the aggressor.

Police Accountability

The Scotland Police is responsible for providing assistance and responding to an incident of domestic violence. The peace officer shall:

Register the complaint and assign a number.

Dispatch a patrol immediately to address the complaint.

The law enforcement officer to hear the case indicates the number of complaint, identify it as domestic violence incident and record the date, time and direction.
