Abstract

This term paper discusses the origin of Jim Crow system and the efforts and sacrifices made by the African American to exercise their rights with freedom. Position Statement

“The Jim Crow System was a symbol of discriminatory and segregating Laws for blacks”

Introduction

The American history is full of events of appalling discrimination. There are many groups including Mexican Americans, Asian Americans, Native Americans, Women, all have been the victim of this unfavorable treatment. On the other hand, experiences of African American with discriminatory treatment have been under exclusive studies and records (Townsend, 2010).

Even if, the constitution and civil rights statutes of United States prohibit the practices of unpleasant favoritism, these regulations have not removed delicate form of discriminatory treatment derived from chauvinism and enduring customs (Thomas, 2005).

The Origins of Jim Crow

In the period of the reconstruction time that followed the ending of civil war, complete citizenship rights, for the newly freed slave population, were sought by Republican political leaders from North. After the 13th, 14th and 15th amendment to the constitution, the blacks were given legal status that appeared to show understanding of that dream. On the other hand, significant resistance from whites to those ideas raised since blacks started taking part in the political and social life of the south, with the assistance of federal troops to implement the regulations.

The determination of the north to enforce consistent military laws on the states from the south to make sure the new independence for black had diminished by 1877. In the year, 1876, the presidential elections resulted in a political concession between democrats and republican, in which one house of U.S. congress was controlled by each of them. In this concession, republicans and democrats decided to approve the electoral votes of Benjamin Harrison, a candidate of Republicans, in response to an end to the substantial reconstruction. Therefore, the entire military force from the south, was pulled out and blacks were required to take care of themselves in declaring their newly awarded freedom. More or less at once, the political gains earned by the blacks were repealed (Thomas, 2005).

States from the south also rebuild the constitutions that left blacks without liberty, and passed a new constitution that limited the rights of blacks to enjoy the liberty, they had enjoyed under reconstruction.

Based on the 13th, 14th and 15th amendment of constitutions blacks challenged those newly passed regulations in order to provide legal support for their position that the laws left them without equal rights. On the other hand, the Supreme Court was found to be a supporter of leaders from south. The Supreme Court redefined many critical decisions, the meaning of citizenship and the scope and width of the amendments resulted from Civil war.
