Tom had an unusually higher than expected tax refund this year and thought it would be fun to own a jet ski. However, Tom had no previous experience in buying jet skis and knew nothing about their mechanical functions and performance characteristics. He saw Mike's advertisement on the internet and arranged a time to visit Mike's shop to view the Jet Ski. The very first warm weekend after he had bought the Jet Ski Tom took it to Gleaning. Within ten minutes after he started using it the Jet Ski stopped working and the engine began to produce lots of smoke. Tom took it to a marine mechanic who informed him that the engine had never been overhauled and was beyond repair. A replacement engine would cost $4000. Tom is angry and upset. Mike tells Tom that he could have had the engine inspected before he agreed to buy it. Mike refuses to refund Tom's money or replace the engine.
