Is Health Care Reform Legal?

Introduction

Healthcare reform is much in our minds these days. On the one hand, it is difficult to find anyone who admits to being opposed to healthcare reform. On the other hand, we may all easily foresee it is going to be extremely difficult to come up with a healthcare reform program that will satisfy everyone.

The perception of health care reform in the United States has not been highlighted properly in the past, and because of that, the health care reform impact and perception is losing its importance. United States is the biggest, most diverse society on the earth, and their medical system also reflects that (Adamini et al, 2009). They spend approximately two trillion dollar per year on health care; around one in every seven dollars in the economy, yet they are still one of the few nations where all citizens do not have medical coverage (Alford, 2008).

Discussion

Health care reform is not seeking to vindicate the power of states to regulate health care. Rather, they are counting on the fact that if they succeed with this legal gambit, the powerful interests arrayed against health care reform—the insurance industry, doctors, and drug companies—will easily overwhelm any efforts at meaningful reform in most states. Unless the Supreme Court is willing to rewrite hundreds of years of jurisprudence, however, they will not succeed (Adamini et al, 2009).

First, rapidly rising health costs are a significant concern. For example, in 2007, the Congressional Budget Office predicted that if current trends continue, in the absence of reform, health care spending in 2035 would wait nearly 31% of GDP.
