Introduction

Racism is a complex problem of our society. It cannot be characterized placed into certain class as it has various complications and lasting effects. However, it is apparent that the ethical values generated the social concern which in turn has to be handled through the means of politics. Hence, if there is an inadequate response of the government regarding the social issues, these problems and concerns will keep on growing. The racism issue in United States will become worse. This prevalence of racism has led to hate crimes. The hate crimes have become quite common in the past few years. These crimes are also known as biased crimes. Hate crimes include acts of verbal intimidation and even physical violence or property damage. Hate crime as defined by the United States' Department of Justice is the violent behavior of racism with the purpose of hurting someone and to threaten someone for the reason of their religion, nationality, race, disability, ethnicity or sexual orientation. Moreover, the main federal investigation organization of United States, Federal Bureau of Investigation, has refers the hate crime as a commitment of crime against a society, property, or person which is motivated in part or as whole, by the bias of offender in opposition to religion, nationality, race, disability, ethnicity, or sexual orientation. In the state of Florida, the legislature authorities have constructed effective and diverse measures for prohibiting the hate crimes execution against the other ethnicities living in the state. Additionally, there are certain legislative constructs that argue that the principle of proportionality must be applied on certain category of criminal offences.

The purpose of this paper is to enlighten and explore the hate crimes in the state of Florida and the United States. In addition, the paper discusses different characteristics of criminal justice and policies that are aimed at the discussion to whether or not principle of proportionality is applicable on the hate crime offenders.
