Ethical Dilemmas and the Criminal Justice System

Introduction

The purpose of this study is to identify and evaluate the ethical and the criminal justice. The study shows that a person which is involved with the current legal issues needs an advocate; however, the advocate knows that the person is mentally ill and is charged with the criminal charges. As an advocate and a social worker, I know that the charged person often uses his mental illness as an excuse to for his inappropriate behavior. This behavior is making the advocate in a big question that weather to go for the ethics or go for the criminal justice. These outcomes of these questions are very vital as it will identify and help the social worker while making the decision about the criminal. But this decision should not be based on the personal assumptions as there are possible chances of making an inappropriate decision about the criminal. So to come over the issue, a social worker should try to find out the facts to resolve this issue.

Discussion

As the social worker and as an advocate, it is a responsibility of a person that his decisions should be based on justice keeping in view that the affected person should not be affected by the wrong decisions. Furthermore, the decisions based on the justice must depend on the ground realities which means it must be based on facts and not on the assumptions.

Ethical dilemmas in Criminal Justice

Ethics and criminal justice issues can be resolved both by philosophical and historical levels. Ethical problems have existed for centuries which are concerned with the government, police and international politics. The law enforcement officers and civil servants are required to adhere to the ethical standards of the code can often be translated by the subjective, the possibility of ethical conduct in the doubt. (Barajas, 1995) Ethical issues about the theft, corruption, violence and off duty behaviors, has become an increasingly serious challenge to the criminal justice.

In criminal law, theft is unlawful taking another man's property without that person's freedom to give consent about the unlawful taking. The term is also used as an informal abbreviation for certain crimes against property, such as looting, burglary, robbery, embezzlement, fraud, larceny, shoplifting, and often criminal conversion. In some areas, theft is considered to be synonymous with the theft, in others, theft has replaced larceny. (Bazemore, Gordon and Lode, 1999)

Some people who carry out such acts of theft are called as thief knows and these acts are known as filching, stealing, or sometimes thieving. Furthermore, the ethical dilemmas and the criminal justice also includes the off duty behaviors which shows the inappropriate behaviors or acts done on duty. Some code has been confirmed to be acceptable behavior; the people who dedicate their lives to these occupations are likely to serve with fairness without any biasness.
