What is Probable Cause?

In the criminal law of the United States, probable cause refers to the standard by which police can make an arrest, conduct an investigation to the person or property of the person or obtain a court order to do so. It is also used to refer to the standard by which a grand jury may believe that a crime has been committed. This term comes from the Fourth Amendment to the Constitution of the United States (Husak, 2008).
