Introduction

This paper will be discussing three cases of the chocolate factory employees. Charlie is the owner of the chocolate factory and he has three problems concerning his employees. We will be discussing the problem as well as will provide the recommendations.

Case 1

This case relates to the employee's workplace health and safety laws and rights of workers 'compensation. In this case the problem is that Dave was working on a machine which mixes the chocolate. The machine had a guard on it but Dave would sometimes remove this because he could work faster. On one occasion he caught his finger in the machine and his finger was amputated. An injured worker for work is entitled to all reasonable and necessary medical care. Although the laws on workers' compensation vary from state to state health care coverage generally include: medical and surgical hospital services, dental services, crutches, hearing aids, chiropractic treatment, physical therapy, nursing care and prescribed medications (Stranks, 2005: 26). The right to receive medical treatment at the employer's expense typically continues throughout the time reasonably and necessarily requires treatment to treat the injury. State laws differ on when the worker can choose their own medical provider. It is important to understand what your rights as an injured worker under the law of compensation to workers in the state within which you are employed (Ridley & Channing, 2003: 21).

According to the health and safety laws the Charlie (owner) has made all the precautions set for the usage of the machine. Also the Dave was informed about the guard that was fixed on the machine. He purposely removed the guard which was set on the machine to work faster. As his finger caught in the machine and was amputated it was his responsibility to take safety measures that were provided to him. There are no liabilities on the owner for this act. Therefore David has to incur his money on the treatment of his finger. Although it is Charlie choice to sympathetically give him reimbursement for the treatment expenses.

Case 2

The situation relates to the laws of employment and the situation was that Eddie an employee of the chocolate factory since one year. Few days ago Charlie decided to dismiss Eddie telling him to go home and he did not want to see him again. According to the laws of employment Charlie cannot make Eddie to leave the company within two to three days. According to the laws of employment Charlie cannot dismiss him employment suddenly, he has to provide him one-two months notice period. Also if he wants to dismiss him suddenly he has to provide him 2-3 months prior salary. If Eddie was caught violating the policies of the company then only Charlie can dismiss him suddenly, because in this case Eddie was on the fault. But if the Eddie not on the fault then Charlie cannot dismiss him employment.
