Although employee privacy rights are not explicitly protected under the Constitution, the right to personal privacy has been attained from assurances found in the First, Third, Fourth, Fifth, and Ninth Amendments. There have been many instances where employees' concerns about their privacy rights have arisen in response to the believed “invasive” tactics, such as drug testing and AIDS testing, that employers use to screen their employees.
