Background of the case

The case is being filed due to violation of fourth amendment. The implementation of Global Positioning system (GPS) device has violated the 4th amendment due to which the Government took the warrant against the GPS device Installation. The device was installed at a place where the respondent was Jones wife. In the context of violation by GPS system, a car stealing case was filed when the car got stolen from Jones's residence.

An insight

According to the Constitution, an amendment may be proposed and can be presented, anf for implementation, it requires two thirds majority voting in both the House of Representatives and the Senate. The original article is then forwarded for processing and publication to NARA's Office of the Federal Register (OFR) (The national archives and records administration NARA, 2012). The OFR maintains the document until it is either adopted or a failed amendment and then it is transferred for protection to the National Archives. Just as an amendment is proposed, it is ratified by three-fourths of the states and then it becomes a part of the Constitution (U.S. Constitution, 2011). It is not compulsory that all the proposed amendments meet the defined constitutional, for example: after the declaration of Independence in 1776, it was stated that “all men are created equal”. This, the institutionalized classification was a reason to pass a constitutional resolution which has now become the 13th Amendment of the Constitution and the abolition of slavery. This amendment provided a clear view that neither slavery nor involuntary servitude was prohibited except as a consequence for any misconduct (National Archives, 2011).

Despite of the clarity and the significance of the constitution, there were still some flaws in it. The Constitution specified the capability of the government but did not specify the boundaries that a government should work within. It failed to include protection against tyranny and did not entail the freedoms and the rights of individuals (American Civil Liberties Union, 2002). It was applied to the consent of the government, meaning to be the property of white men only. The Government allowed global Positioning System devices to trace the vehicles and to reduce the crime significantly, but the wrong use of the technology caused problems and many were found guilty of accusing it (Cassell, 2005, pp.835-925).

Justification of the Case

The United States Court of petition of Columbia overturned the certainty on account of justification of evidence which was taken by issuing the warrants against the use of GPS device, since it has violated the fourth amendment according to the court of law. The District of Columbia had refused the appeal and refused to re-hear the case of GPS violation (Tribune Business News, 2006).
