Q1) Differeence between desperate treatment and disperate impact
Disparate impact is observed when discrimination is exercised by utilizing official channels and thus leaving no evidence or proof that any discrimination has been exercised (Franz & Lahey, 2012; King, Dunleavy, Dunleavy, Jaffer, Botsford Morgan, Elder & Graebner, 2011). This is generally observed in cases where organizations make policies that end up impacting a protected group. In such cases, there is no mandatory need for evidence that may confirm intentional discrimination. The advantage of disparate impact is that it makes use of an otherwise innocent approach but violates rights nonetheless by exercising practices that can best be described as discriminatory (Gomes & Espinosa, 2010; Miller, 2012). In contrast to Disparate impact, Disparate treatment is the exercising of measures that directly (and with all intention) target the interests of a protected group. In such cases, Disparate treatment is generally easy to identify and verify the intentional exercising of discrimination.

Throughout history, we have witnessed that nations have always faced challenges in achieving co-existence and peace in their societies (King, Dunleavy, Dunleavy, Jaffer, Botsford Morgan, Elder & Graebner, 2011; Newman & Isenhath, 2010). Similarly, America is one of the nations which is referred to as the “melting pot” due to diverse ethnic and cultural races living together. The freedom of speech, liberty and freedom to practice one's own religion have been the fundamental rights of citizens in America (Miller, 2012; Franz & Lahey, 2012).
