Abstract

The paper aims to emphasize on the major causes of overcrowding in the prisons. The prison system is an institution set aside for many countries. The dynamics of the right to punish is closely related to the constitution of State. Overcrowded prisons pose a greater risk of the spread of infectious diseases. It is estimated that about 30 per cent of all prisoners suffer from heart disease, while in the general population, this percentage is 10 percent. Similarly, in the case of Hepatitis C as well as HIV infections occur.

Overcrowding in prisons is a problem that many of the institutions throughout the world are facing and have a negative impact on physical and mental health inmates of the prisoners. There are several causes that contribute to such collapse. The state itself in successive governments, whether at federal or state, has not yet found adequate solution to the problem. The right to punish is an element that enables the existence of social organization, i.e., the prison system is much more than a place to imprison or play individuals violators of the legal-social. The analysis of the prison system fits on the list of issues to which science Politics can not steal. That is the question penitentiary, included in one of the challenges of science, whose aim is to establish a better understanding of the problems of the state. The immediate problem of the prison system is the search for the causes that effective generate overcrowding, because, according to the report data DEPEN, 2004, all federal units have vacancy deficit. There are many problems that are viewed the scene in the prison system. However, if not solved overcrowding, others persist.
