Introduction to the Criminal Justice System Court Observation
Introduction
I have been to the magistrate court for 3 days. The tense faces and the rush was the same. However, the cases vary, the punishment and the sentence alters. Though the role, of the administrative staff was same. The tiring people and the straight faces make the atmosphere even more serious. I am going to discuss my visit and the activities I noticed in the paper. Discussion Activities in the Court
More than 100 people are scheduled each day and even at the same time. It is a bounded area, and so many people accommodating in it, gives it a tacky and a tousled look. Before the trial, some prosecutor talks to the court authorities in the pleading guilty. If the prosecutor thinks that your case is strong, so they can offer you a plea bargain. The stronger the case is the chances of the plea bargain increases. It might be open to bargain, or sometimes it is a definite offer, you might take it or leave it. However, the plea bargain has probation of 30 to 90 days (Peters, 2006, Pp. 98-154).
The judges are the experience people, and they can easily differentiate between the shaky and a plotted case and the historical happenings. The court administrative staff organizes the details of the cases with which the court is going to deal (Singer, 2010, Pp. 543-589). The usher of the court, announces the case, mainly in the lists order, but mostly it is announced with the people whose concerns are ready (Kant, n.d. Pp. 1-3). The clerks are position to identify each defendant by the name, reads out the charge they have been called for or the reason for which the court is set. The clerks deal with the magistrate whom applications are to be made and then they call advocates for the judgments. However, in every circumstance, the prosecution and the defense get the chance to speak out their reasons and justify themselves. However, the hearings are considered and according to the evidence, witnesses and the seriousness of the case, the sentence is made (Lee, 2004, Pp. 1-9). Characters in A Magistrate Court
The magistrate room is crowded with a lot of people, the decision makers, the guilties and other supportive characters. However, the characters I noticed on my day at the court are:
Magistrate
According to the sensitivity of the case and the matter, the number of judges varies from 1-5. There are two types of judges, the lay magistrate and the district judge. Both the judges have the same function and the same authority, however, the district judge sits alone, and he is legally qualified (Lee, 2004, Pp. 1-9). One of the Magistrates takes the chair to announce the decision, although the decision which is communicated is mutual.
The Clerk
The clerk acts as the central character. He or she advises to the court and also commands ...
