Introduction

The main purpose of this paper is to make a case analysis of Maggie Scoot, who used to work in second shift and once she came back to home she found that things are messed up. She called the police that someone has entered her home in her absence. After investigating from Scott's landowner, the cop named Peter came to know that on that day Scott's ex-boyfriend Nick Owens has entered her room. Investigation shows that Nick Owens actually came to steal the money which Scott used to keep in the drawer every Friday night. But this time she could not keep it, so Nick Owens could not find it and he just took the juice and went away. Now, this case analyzes that whether the state should charge Nick Owens with burglary or not?

Case Analysis

In my view Nick Owens should be charged of the Burglary, this is because either he has not taken anything but actually he came there with the intentions of stealing the money which Scott used to keep in the first drawer. After finding the evidences by the fingerprints and other, it could be very easy for the Peter to find out that it was Owens who came there for the robbery. According to the criminal act, any person who enters in any place with the intentions of burglary would be penalized for it. It does not matter whether he has actually stolen anything or not, but if he entered there this means that he should be charged of it.

According to the section 9 of the theft act, any person who enters in a building having the intentions of burglary should be penalized for at least 3 years. The term burglary can be defined as the entrance and the encroachment into a person's property which does not belong to you. The term of burglary can be treated as the statutory crime and is referred to as encroaching into someone else's property. It can be called robbery or vandalism sometimes, but not in all cases. The person to be charged of burglary may differ on the basis of several factors i.e. the state law and the procedures.
